1. About LovLatch
LovLatch is an Australian-based jewellery brand offering functional jewellery products designed for adults. Our products are intended to be worn and used only by adults.
2. Important Safety Warnings
STRICTLY NOT A TOY
LovLatch products are not toys, teething products, feeding products, pacifiers, baby accessories, or child-use items.
They must never be given to, handled by, worn by, played with, chewed by, or left within reach of any baby, infant, toddler, or child.
Choking / Strangulation / Injury Risk
LovLatch products contain components such as chains, clasps, pendants, and metal parts that may present serious hazards including: choking, strangulation, entanglement, pinching, breakage hazards, injury if misused.
Children can be seriously injured or killed if exposed to jewellery or small components.
Adult Supervision Required
LovLatch products are intended for use by competent adults only. They must be stored safely and securely away from children at all times.
Not for Sleeping / Unattended Use
Do not wear LovLatch while sleeping, napping, bathing, exercising, operating machinery, or in any circumstance where snagging or entanglement may occur.
Inspect Before Use
Do not use if damaged, bent, loose, cracked, weakened, or showing wear. Discontinue use immediately if any component becomes defective.
3. Product Purpose Disclaimer
LovLatch products are jewellery items with optional functional features intended for adult convenience only.
They are not medical devices, maternity devices, breastfeeding aids, child restraint devices, nursing safety devices, or products intended to secure, hold, carry, or support a child.
Any references to convenience or styling are descriptive only.
4. No Guarantee of Suitability
Customers are solely responsible for determining whether a LovLatch product is suitable for their personal clothing, wardrobe, lifestyle, and intended adult use.
LovLatch makes no guarantee that any product will work with every garment, body type, fabric, or use case.
5. Use at Your Own Risk
To the maximum extent permitted by law, you acknowledge and agree that use of LovLatch products is at your own risk.
Improper use, misuse, alteration, failure to supervise, failure to follow warnings, or allowing child access is entirely the customer’s responsibility.
6. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees that cannot lawfully be excluded under the Australian Consumer Law or other applicable consumer protection legislation.
Where permitted by law, our liability is otherwise limited to:
- replacement of goods;
- repair of goods; or
- refund of the purchase price paid.
7. International Customers
If you purchase outside Australia, you are responsible for ensuring the product complies with local laws, import rules, taxes, duties, and regulations in your country.
LovLatch does not guarantee compliance with every overseas jurisdiction.
8. Orders and Pricing
All prices are listed in the currency shown at checkout. We reserve the right to change pricing, descriptions, or discontinue products at any time without notice.
We may refuse or cancel any order where required for fraud prevention, stock errors, pricing errors, or legal compliance.
9. Shipping and Delivery
Delivery timeframes are estimates only. LovLatch is not liable for delays caused by carriers, customs, weather events, strikes, or circumstances outside our control.
Risk in goods passes to the customer to the extent permitted by law upon delivery.
10. Returns and Refunds
Returns, exchanges, and refunds are governed by our separate Refund Policy, together with any rights you may have under applicable law.
Nothing in our policy limits rights that cannot legally be excluded.
11. Intellectual Property
All website content including logos, branding, designs, images, product names, copy, graphics, and trademarks remain the property of LovLatch and may not be used without prior written consent.
12. Limitation of Liability
To the fullest extent permitted by law, LovLatch is not liable for any indirect, incidental, special, punitive, or consequential loss arising from:

- failure to follow warnings
- wear and tear
- third-party shipping issues
- allergic reactions to metals where materials were disclosed
- damage caused by snagging, pulling, or improper handling
Where liability cannot be excluded, it is limited as allowed by law.

You agree to indemnify LovLatch against claims, losses, or liabilities arising from your misuse of products, breach of these Terms, or failure to keep products away from children.
14. Governing Law
These Terms are governed by the laws of Victoria and the laws of Australia. Courts of Victoria have non-exclusive jurisdiction, subject to mandatory rights in other jurisdictions.
